Buying or Selling Property in Turkey Using a Power of Attorney

When buying or selling property in Turkey, both the buyer and seller are legally required to attend an appointment at the TAPU (Title Deeds) Office to complete the transfer. If attending in person isn’t possible, a Power of Attorney (POA) allows a trusted representative to sign on your behalf, ensuring the transaction is safe, legal, and stress-free.


What is a Power of Attorney?

A Power of Attorney is a legal document that authorises another person to act for you at the TAPU office. In Turkey, a “simple” Power of Attorney is commonly used for property transactions and only covers signing documents. It does not include financial powers such as paying balances or handling mortgage accounts.

If you wanted assistance in sending monies back to the UK from your Bank account in Turkey account, this can also be written into the Powers given.  For properties with mortgages, it will also need to include payment and closure of mortgage accounts.


Power of Attorney in Turkey

If you are in Turkey, we will take you to a local noter (notary) to complete your Power of Attorney. An independent translator will explain the document and its purpose. Your passport will be translated, your photo added, and the document notarised.


Power of Attorney from the UK

If you are in the UK, the POA process is as follows:

  1. The POA is drafted in English and sent to your chosen UK notary for signing (We normally ask for your post code and obtain 3 quotes from local noters and choose the closest or cheapest option)
  2. The notary witnesses your signing of the document and stamps the document, then sends it to the UK Government for an Apostille (official legalisation).
  3. The document is returned to us, translated into Turkish, notarised locally, and ready for use.

How a Power of Attorney Works

Once completed, the person acting as your POA will attend the TAPU office to sign on your behalf, only after your property balance has been paid or arranged.
